The Secretary of the Territory was established as an appointive office in 1846 by the Kearny Code. The office was continued by the Organic Act of 1850 (Sec. 4; and Sec. 12.). In 1912, with statehood, the office of Secretary of State became an elective one (1912 New Mexico State Constitution, Art. V, Sec. 1).
